SUBANG Jaya police have opened investigations into the death of a pet dog in SS17 which is alleged to have died after consuming food laced with poison fed by a resident.
Subang Jaya OCPD ACP Wan Azlan Wan Mamat said police had received a report lodged by the dog owner on Feb 16.
“The Belgian Shepherd was allegedly poisoned. We have sent the dead dog to Universiti Putra Malaysia’s Veterinary Hospital for an autopsy to determine the cause of death.”
“The results of the autopsy should be available in a few days time. We have opened investigation papers under Section 428 of the Penal Code,” he said.
Section 428 makes it a crime if a person causes mischief by killing, poisoning, maiming, or rendering useless animals. It carries a penalty of up to three years’ imprisonment, a fine, or both. The quantum of the fine is at the judge’s discretion.
Wan Azlan said police had also received the CCTV footage from the dog owner. The footage has an image of the suspect.
“We will carry out our investigations under Section 428 first and once the evidence is conclusive and the suspect is in custody, we will most likely recommend to the deputy public prosecutor to charge the person under Section 30 of the Animal Welfare Act 2015,” he added.
Section 30 of the AWA provides for up to three years imprisonment, a fine between RM20,000 and RM100,000, or both. The new law came into effect on July 1 2017.
A police report was lodged by Wong, the dog owner at 1.22am on Feb 16 2023. In the report Wong said that at 12.10am, her Belgian Shepherd had started vomiting. Suspecting something amiss, she had checked her CCTV and discovered from her footage that a person had thrown something into her compound at 11.32pm.
In her report, Wong said this was not the first time that she had found things thrown into her compound. She said on one occasion, she had found a clump of bread with “medicine” inside it and on another occasion her child had found “sweets” in the compound which she also suspected may be drugs or poison.
Wong in her report said she had not lodged a police report earlier as she had no proof. She stated that she now feared for her child’s safety.
She said the CCTV footage clearly showed a person throwing something into her compound just before her dog died.
